My $.02 is that until recently, ORDA probably didn't think it was necessary to apply for the Article XIV exemption. In the ORDA world, van Ho was a backwater compared to revenue generators like Whiteface or Gore (my words, not theirs). I've heard talk thAt the refrigeration plant for the sliding track straddled DEC and North Elba land.

If I remember rightly, the Article XIV exemption has to pass in legislature twice before it can be a public referendum.


The increased number of major events at the Ho in the last few years may have spurred ORDA - or someone - to finally apply for the exemption. This is strictly speculation on my part, I haven't discussed this with anyone at ORDA.

So, any time a municipality within the Adirondack Park seeks to have a portion of land within their town reclassified by the APA for increased density, the APA always requires a portion of land within that town to be reclassified with less density. Hamlet (1/3 acre) and Moderate Intensity (1.3 acre) zoning allows the most density and commercial uses, and Rural (8.5 acre) and Resource Management (42 acre) are Zoning Areas that the APA likes to see traded for.
Heaven forbid the APA give something without getting something in return, and that is what is happening here with Mt Van Ho...total bullshit :poop: :unsure:
 
So Van Ho cut trees in the Forest Preserve and now they are going to make it legal after the fact? ORDA didn't know the law or they ignored it?

What happens if it gets voted down? Do they reforest the land and get rid of the trails? What is the punishment for cutting 2500 acres of forest preserve?

What groups will qualify for situations like this, where the law is broken, and then changed? Seems like an odd precedent.

If ORDA, or whoever, had worked to secure an Article XIV exemption for the Ho 35 years ago, we wouldn't be having this discussion.
 
I googled it. The penalty is $200 per tree. Sort of pointless to levy the fine on taxpayers. Seems like there should be some consequence for breaking the law.
Google only says that’s for State land and could be more in the Forest Preserve. I couldn’t find any listed penalties on the DEC site for illegal tree cutting only for moving firewood. I’m sure of one thing though, if I went up there and started cutting down trees there would be a hefty fine and if I kept doing it I would be put in jail.
