Hey guys, I just want to clear the air about some things. First off, you really don't want to discuss litigation in public when you are trying to negotiate in good faith. This isn't national news, it's a civil disagreement between two parties and if it was straightforward there would have been an injunction against my business 9 months ago. Secondly, I have yet to see a single comment discussing this lawsuit nor my actions that is accurate. If you see a claim that maybe looks plausible or truthy, consider the source and their deminor, and demand proof of their claims before believing them otherwise you may become part of the lie. Third, most of the people on various forums besides this one are the same small group of people who have an agenda to do me harm, in fact one of them operates over a dozen aliases and has even impersonated me. That cyberstalking campaign started on March 20, 2020 immediately after the COVID closures based on political beliefs that I would not allow to infect my group when we needed to all work for the greater good.
Regarding my own actions in relation to adopting the Skiology name, I can offer that when I chose this name for my business in December of 2018, almost 5 years ago, I did a thorough search for all other uses of the name and was unaware of this small ski shop until quite a while later after multiple public actions and announcements including an interview I did with Harvey in May of 2019. Discovering this ski shop was not possible through reasonable means when I did my search otherwise I would have found them. They didn't have a trademark, their business registration had been terminated shortly before my search, their logo was similar to the much better established Skiology Chalets in the UK which dominated search results at that time, and their website likely experienced changes and downtime based on the historical record on archive.org during a period of more than 2 years which likely affected my ability to find them in Google. I obviously can't prove a negative, but I would have chosen a different name at that time if I had known about this ski shop's existence just simply to avoid even the possibility of random people thinking that I copied someone else's name, and I wanted as unique of a name as possible since that is the way people find my business. I'm sure we were both disappointed to learn about each other when we did almost a year after our initial launch, I certainly was. They waited well over 3 more years to contact me and file suit. We filed our answer in court about 10 days ago, truthfully denied a great deal of what was claimed, and that will have to serve as all I can offer about the case itself for the time being and quite possibly forever if it is settled. If you are a lawyer then you surely get it. It may be unsatisfying to your curiosities, but that's how it works and It's not like I don't want to defend myself more fully from some of the claims being made, I most certainly do. I would rather talk about skiing and riding though of course.
As far as my business goes, we finally launched a long, long overdue subscription service this summer. I had intended to do this in 2020 but with the pandemic and then deaths of loved ones in the next two summers I was incapable of making the leap. This summer of course I am being sued and there are serious health concerns among two more people I love, but I trimmed my plans for how to make the leap and have done so very successfully in this first phase, thank God! People need to remember that I'm a human being and a regular guy just like you all. Life happens, and it's hurtful and harmful to see people speculating about why I do what I do because they either want to do me harm or they simply think it's cool to talk about people on the internet. I don't like to make excuses in public or share personal details, but that shouldn't be carte blanche for others to speculate about. I run a very small business and I'm both the president and janitor. My goal is simply to help people have better ski days because I love sliding on snow and wanted to share my passion and what I knew with others. I do not desire to be a personality at all, but I have to serve a role. It is other people who in fact create most of the drama and this thread unfortunately has a fair deal. It was so much easier before the pandemic and with just 10,000 followers, but now I have 60,000 unique followers and not all of these people are right in the head or have good morals and ethics of course, and some people are unfortunately gullible and believe things they see on the internet without any actual proof. I don't expect all 60,000 people to like me, nor should you, it just doesn't work like that. If people don't like me then they should avoid me like any normal person would. If people find more value elsewhere, they should spend their money and their time with them instead. It's that simple.
In my group we don't allow any personal attacks, and a thread like this would never ever be allowed but Harvey sets his own rules and that's his right even if I might disagree. If you are wondering how my group became the biggest regional ski group in the world when it was started by a nobody outsider with limited experience at the time, it definitely wasn't due to drama because good people flee that on social media, but instead it benefitted from the lack of of drama in comparison to most other larger forums where trolls dominate. I of course work hard and take pride in my work, I try to provide value, and I try to maintain a safe and friendly environment. My goal this season is to sell subscriptions to maybe 5% to 7% of my following and eventually become an app with deterministic weather added and with zero social media interaction. We'll have sponsors, but I'm not going to sell out to the ski industry and carry their water because I want sponsorship money. I want Skiology to be for skiers and riders and be an honest resource, and not have it be simply yet another marketing wing of the industry where their money makes the news almost always good. We will likely always make the vast majority of our money from skiers and riders, and I prefer it that way.
I you guys have an honest question for me, then ask it here and I'll answer as long as it doesn't deal with the lawsuit. Seriously, if you really want to know the truth or what I actually think or did instead of speculating about it or believing some anonymous troll on the internet or possibly your own speculation, then just ask. I'm not scared of the truth and I welcome the opportunity to tell it.
